Terms of Use

WhoTap is an offline party game from Luis Suárez, who operates under the name Luewell (“Luewell,” “we,” “us”). These Terms of Use (the “Terms”) are an agreement between you and Luewell governing your use of the WhoTap app. By downloading or using WhoTap, you agree to these Terms.

1. License to use WhoTap

Subject to these Terms, Luewell grants you a personal, non-exclusive, non-transferable, revocable license to download and use WhoTap on Apple devices that you own or control, for your own personal, non-commercial entertainment. You may not copy, modify, distribute, sell, rent, reverse engineer, or attempt to extract the source code or content of the app, except to the extent this restriction is prohibited by applicable law.

2. Who can play

WhoTap is intended for people aged 13 and over and is not directed to children under 13. If you are under the age of majority where you live, you may play only with the permission of a parent or legal guardian, who is responsible for your purchases. Adults who play with minors are responsible for choosing suitable modes and supervising them.

3. The game

WhoTap is a party game for entertainment. Players put their fingers on one device and the game picks one or more of them at random. In Free mode the group decides what the chosen player does; the Questions and Challenges modes show a question or a quick challenge. The result is random and only meant for fun: it must not be used to make real decisions, settle bets, or assign obligations. We may add, change, or remove modes, content, and features over time.

4. Play safely and respectfully

The game only suggests; the players decide what they do. Do a challenge only if it is safe for you, the people around you, and the place where you are, and never put yourself or others at risk or break the law. Every turn can be skipped, and nobody has to answer a question or do a challenge. Respect the other players’ limits, privacy, and consent. You are responsible for your own choices and actions while playing.

5. Ads and the “WhoTap Pro” purchase

The free app shows full-screen ads from third parties, served by Google AdMob, between rounds — only after you tap “Play again” and never during a round. We are not responsible for the content of third-party ads or for the products and services they promote.

“WhoTap Pro” is a one-time purchase processed by Apple through your Apple ID and managed through RevenueCat; it is not a subscription and does not renew. Today it removes the ads between rounds; that is all it includes, and it cannot be shared through Family Sharing. The price is shown in the app before you buy and may vary by region. It is unlocked on the device where you buy it and can be restored on your other devices that use the same Apple ID with “Restore purchases.” If Apple refunds or reverses the purchase, the unlock is removed and the ads come back.

Refunds are handled by Apple according to the App Store terms; Luewell cannot issue App Store refunds directly.

6. Your data

WhoTap has no accounts, so your settings exist only on your device and we keep no copy; they are lost if you delete the app. Our handling of information is described in our Privacy Policy.

7. Intellectual property

WhoTap, its name, design, software, art, sounds, and its questions and challenges are owned by Luewell or its licensors and are protected by intellectual property laws. These Terms do not grant you any rights to Luewell’s trademarks or branding.

8. Disclaimer of warranties

WhoTap is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including fitness for a particular purpose. We do not warrant that the app will be uninterrupted or error-free, that every question or challenge will suit every group, or that your settings will always be preserved.

9. Limitation of liability

To the fullest extent permitted by law, Luewell will not be liable for the decisions and actions of players, for any indirect, incidental, or consequential damages, or for any loss of data, arising out of or related to your use of WhoTap. Nothing in these Terms limits liability that cannot be limited under applicable law.

10. Apple’s role

WhoTap is distributed through Apple’s App Store. Apple is not a party to these Terms and is not responsible for the app or its content. This agreement is between you and Luewell only. Apple’s standard App Store terms also apply to your download and use of the app.

11. Termination

These Terms apply while you use WhoTap. You may stop using the app at any time by uninstalling it. We may suspend or end your access if you materially breach these Terms.

12. Changes to these terms

We may update these Terms from time to time. When we do, we will revise the “Effective” date above. Significant changes will be reflected on this page, and your continued use of WhoTap after changes take effect means you accept the updated Terms.
