Terms of Use

Memory XYZ is a memory card game from Luis Suárez, who operates under the name Luewell (“Luewell,” “we,” “us”). These Terms of Use (the “Terms”) are an agreement between you and Luewell governing your use of the Memory XYZ app. By downloading or using Memory XYZ, you agree to these Terms.

1. License to use Memory XYZ

Subject to these Terms, Luewell grants you a personal, non-exclusive, non-transferable, revocable license to download and use Memory XYZ on Apple devices that you own or control, for your own personal, non-commercial entertainment. You may not copy, modify, distribute, sell, rent, reverse engineer, or attempt to extract the source code or content of the app, except to the extent this restriction is prohibited by applicable law.

2. Who can play

Memory XYZ is suitable for all ages. If you are under the age of majority where you live, you may make purchases only with the permission of a parent or legal guardian, who is responsible for them.

3. The game

Memory XYZ is a memory card game for entertainment. Duel opponents and the other players in the practice ranking are AI players created on your device; there is no online play. We may add, change, or remove modes, themes, rewards, and features over time.

4. Coins

Coins are a virtual in-game item that you earn by playing or buy in coin packs, and spend to unlock themes and enter duels. Coins have no cash value, cannot be exchanged for money or transferred, and are licensed to you, not sold. They are stored only on your device and are lost if you delete the app or lose the device; coins already spent or lost are not refunded or restored. We may change how coins are earned and what they unlock.

5. In-app purchases

Premium themes, “Unlock all themes,” and coin packs are one-time purchases processed by Apple through your Apple ID and managed through RevenueCat; none of them is a subscription or renews, and they cannot be shared through Family Sharing. Prices are shown in the app before you buy and may vary by region. Unlocked themes can be restored on your other devices that use the same Apple ID with “Restore purchases”; coin packs are consumed when bought and are not restored. If Apple refunds or reverses a purchase, we may remove what it unlocked.

Refunds are handled by Apple according to the App Store terms; Luewell cannot issue App Store refunds directly.

6. Your data

Memory XYZ has no accounts, so your progress, coins, and settings exist only on your device and we keep no copy; they are lost if you delete the app. Our handling of information is described in our Privacy Policy.

7. Intellectual property

Memory XYZ, its name, design, software, card art, and other content are owned by Luewell or its licensors and are protected by intellectual property laws. These Terms do not grant you any rights to Luewell’s trademarks or branding.

8. Disclaimer of warranties

Memory XYZ is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including fitness for a particular purpose. We do not warrant that the app will be uninterrupted or error-free, or that your progress and coins will always be preserved.

9. Limitation of liability

To the fullest extent permitted by law, Luewell will not be liable for any indirect, incidental, or consequential damages, or for any loss of data or virtual items, arising out of or related to your use of Memory XYZ. Nothing in these Terms limits liability that cannot be limited under applicable law.

10. Apple’s role

Memory XYZ is distributed through Apple’s App Store. Apple is not a party to these Terms and is not responsible for the app or its content. This agreement is between you and Luewell only. Apple’s standard App Store terms also apply to your download and use of the app.

11. Termination

These Terms apply while you use Memory XYZ. You may stop using the app at any time by uninstalling it. We may suspend or end your access if you materially breach these Terms.

12. Changes to these terms

We may update these Terms from time to time. When we do, we will revise the “Effective” date above. Significant changes will be reflected on this page, and your continued use of Memory XYZ after changes take effect means you accept the updated Terms.
